www.FMRecruiter.com is a jobs board, our primary purpose is to help Job Seekers to find jobs and to help Recruiters to find suitable candidates for their jobs.
If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

Definitions
The following definitions apply:
“FM Recruiter”, “Company”, We”, “Us”, “Our” means Stave Solutions Limited trading as FM Recruiter registered in England and Wales number 13432765.
"Recruiter" means any person, company or organisation that has set up an account with FM Recruiter for the purposes of finding candidates for either their own jobs or as an agent acting on behalf of another organisation looking for candidates to fill their jobs.
“Job Seeker” means an individual who has registered to use the FM Recruiter Site for the purpose of finding a job.
"Commencement Date" means the date for the commencement of the Services as set out in the Order Confirmation.
"Order Confirmation" means, for online orders, an email confirmation sent by Us confirming the purchase of one or more of the Services; and in the case of orders made via the FM Recruiter sales team, the approval of a formal quotation provided by Us which contains details of the Services ordered by the Recruiter and the price.
"Services" means all of the recruitment services provided by Us from time to time.
“Contract” means the contract between Us and the Recruiter for the provision of Services governed by these Terms.
"Terms" means these terms and conditions.
"Site" or “Website” means www.FMRecruiter.com and its content.
“User” means an individual working at the Recruiter who the primary account holder has provided with a login by which they can access Our Services and Site on behalf of said company or organisation. Every User has the same abilities and access to the Services as the primary account holder and must abide by these Terms in their use of the Services and Site. The failure of any User to abide by these Terms may result in the suspension of termination of Service.
Use of the Site
You are permitted to use the Site for the purposes of recruiting staff for your own company or organisation or as an agency helping another company or organisation to recruit, or to access advice contained within the Site. You may only use, download or print information from the Site for these specific purposes. You should not keep any information that you download or print from the site for longer than necessary. Recruiters may not otherwise copy, display, transmit or distribute any material from the Site and if you do or if you perform any other unauthorised processing of information on the Site it shall be deemed a material breach of these Terms which shall entitle us to terminate the Services immediately.
At all times Recruiters must adhere to the requirements of the Employment Rights Act 1996, Equality Act 2010, Data Protection Act 2018 and any other applicable laws in your treatment of Job Seekers who may respond to a job advertisement you have posted and with regards to Job Seekers you may contact using information from our CV database. You must deal with Job Seekers in a fair and professional manner at all times in all dealings and correspondence.
You must not do anything which may bring FM Recruiter or the Site into disrepute. You will indemnify Us from and against any claim brought by an individual against Us arising from your breach of this obligation or any other of these Recruiter Terms.
The Recruiter, if an employment agency or an employment business, will comply with the provisions of the Conduct of Employment Agencies and Businesses Regulations 2003 ("the Regulations") and the Employment Agencies Act 1973 in relation to all jobs posted on the Site, communications with job seekers and management of job seeker's details. The Client shall indemnify FM Recruiter against any Losses in connection therewith.
We reserve the right to suspend provision of all and any Services to you where we reasonably believe that you have performed any unauthorised processing of information.
In respect of any personal data accessed, downloaded or otherwise processed by a Recruiter as a result of access to the Site or the Services, the Recruiter agrees that it shall be the sole Data Controller of such personal data as defined by the UK GDPR and as such, shall be solely responsible for its processing.
All copyright, database rights and other intellectual property rights in the Site and the material available on the site belongs to FM Recruiter or its third party suppliers. Use of the Site does not give you any proprietary rights in such materials.
Provision of Services Recruiters
These Terms and Conditions apply to your agreement with Us for your use of the following services, which collectively will be known as the “Services”. Terms and Conditions apply to all of the Services except for where they are expressly stated to apply to one Service only.
1. Job Posting service, which allows Recruiters to place job advertisements on the FM Recruiter website and for Job Seekers to view and apply for these jobs by making an application directly through the Site or by being re-directed to a third-party website to apply through that website.
2. Featured Job Posts, which provide greater prominence than a standard Job Posting by inclusion in a carousel on the Website home page and by Featured Job branding in Job Seeker job search returns.
3. Optimised Job posts, which in addition to the benefits of Featured Job Posts also include advertising of the Job Post within the Rail Business Daily newsletter for a minimum of 1 day, advertising in the FM Recruiter weekly jobs newsletter for a minimum of 1 release and a LinkedIn post to the Rail Business Daily audience.
4. Ultimate Job posts, which in addition to the benefits of Optimised Job Post includes advertising on the FM Business Daily news website page for 1 week. The advertisement will be created by FM Recruiter. The shape and size of the advert will be at the discretion of FM Recruiter and will feature FM Recruiter branding in a standard template. The advertisement will form part or a rotating carousel including other jobs or advertisements.
5. CV Search, which provides the Recruiter with access to a search engine for the purpose of finding and viewing Job Seeker CVs and profile information which match the criteria and filtering set by the Recruiter. Various bundles of CV downloads may be purchased, see additional information in the Pricing section below. Recruiters can elect to view and/or download a CV at their discretion subject to the payment of a credit.
6. Featured Recruiter, which provides the Recruiter with a logo on the home page of the website that links to their Recruiter Directory entry where they can create a profile of their organisation for an agreed time. Or where upon agreement FM Recruiter can populate the Recruiter Directory on behalf of the Recruiter for an agreed fee which will be based upon the individual requirements of each Recruiter.
7. Candidate Alerts, which allows Recruiters to specify criteria and then receive emails containing details of Job Seekers that fulfil that specified criteria on a frequency that they determine. Recruiters can set up multiple job alerts and Recruiters can amend or stop alerts at any time by accessing their dashboard.
8. Job Boosts, various additional services provided by FM Recruiter from time to time to extend the reach of Job Posts which include advertising in the FMbusinessdaily.com newsletter and advertising on FMbusinessdaily.com website.
FM Recruiter may, in its sole and absolute discretion, add to, modify or discontinue any of the Services from time to time. However, this will not affect any Order Confirmation agreed prior to any change or withdrawal of the relevant Service.
The Recruiter shall not resell any Services without the express written permission of FM Recruiter.
FM Recruiter shall provide the Services in accordance with these Terms. Recruiters must set up an account in order to gain access to the Services.
Job Posts
By submitting a vacancy to the Site, the Client is authorising FM Recruiter to post such vacancy on the site.
At the discretion of FM Recruiter, a Service may be offered where jobs are replicated from a Recruiters website or some other nominated source. Where this Service is offered FM Recruiter will make all reasonable attempts to replicate the job description accurately.
FM Recruiter may at its discretion offer software integrations including Broadbean and Logic Melon which enable Recruiters to submit vacancies via this software. We retain the right to change or discontinue the provision of these software integrations at any time.
The Recruiter is responsible for the content of the vacancy regardless of whether this is submitted directly, via third party software or if the posting is replicated from their website or other nominated source and will indemnify FM Recruiter against any claim, loss, liability, expense and/or damage ("Losses") in connection therewith.
Job Posts will be active for a maximum of 30 days. Recruiters can elect to set a close date earlier than 30 days at their discretion. A Job Post can be reposted after it has ended for a charge of 1 credit.
FM Recruiter does not guarantee any response to your Job Post or that responses will be from individuals suitable for the job advertised.
Rules for Job Posts
The following rules apply for all Job Posts including Featured job Posts, Optimised Job Posts, Ultimate Job Posts and any other Job Posts FM Recruiter might offer as a Service from time to time. These rules are designed to ensure that Recruiters receive the most applicable response to their jobs and that Job Seekers are treated fairly and safely.
The Recruiter must include the following information in the job post:
The Recruiter must provide sufficient true and accurate details about itself and the job to applicants including, but not limited to the Recruiters identity, the nature of its business, the nature of the role, the requirements of the role, the commencement date, the likely duration, the hours of work, the location, the remuneration, the intervals of payment and available benefits.
Applications will either be sent to the Recruiter by an email from FM Recruiter or via an application made on their own website which is made accessible from a link in the job post. Recruiters can choose which of these options to use when setting up a job post. When a Recruiter chooses to receive applications by email the application will include the CV and personal information provided by the Job Seeker in support of their application and this information will also be accessible in their account. The Recruiter will be the sole Data Controller for this information and will have the same responsibilities to adhere to data protection legislation as though they downloaded the information from the Site.
The Recruiter is solely responsible for verifying the information provided by a Job Seeker in their application. The Recruiter is responsible for checking the Job Seekers identity, qualifications, skills, experience, eligibility to work, training, membership of professional bodies and all other information provided. FM Recruiter accepts no responsibility for validating information provided in any application and makes no warranties as to the accuracy of said information
All and any subsequent dealings between the Recruiter and any Job Seeker in connection with the applicant's response to the job posting are the responsibility of the Recruiter, and FM Recruiter accepts no liability whatsoever therewith. The Recruiter will indemnify Us against any Losses in connection therewith.
The Recruiter must not duplicate jobs.
The Recruiter must not place any contact details in any job description, including but not limited to URLs telephone number and email addresses. Applications should only be encouraged via the Apply Now button on each Job Post which will either enable the Job seeker to apply via the Site or will redirect them to the Recruiters own website for the purpose of making an application.
Job Titles and descriptions must not include strings of keywords that are designed to improve ranking on pages to the detriment of the understanding of the Job Post.
The Recruiter must only advertise legitimate jobs in good faith. The posting of adverts for jobs that do not exist, pyramid schemes, franchise opportunities and other products and services are not allowed. The Recruiter must not request that any Job Seekers who make an application make a payment in order for their application to be processed.
Recruiters must remove Job Posts at the earliest opportunity after a Job is filled or if it becomes unavailable.
All jobs posted on the Site must have an active link to the Recruiters website where this is the method of application. Links must be active and enabled for the duration of the Job Post.
The Recruiter will comply with all applicable laws, including without limitation: the Data Protection Act 2018 and the Equality Act 2010.
Any vacancy submitted to the Site must comply with the Code of Practice on Employment provided by the Equality and Human Rights Commission, which can be viewed at: https://www.equalityhumanrights.com/en/publication-download/employment-statutory-code-practice
The Recruiter shall not submit for inclusion in any job posting any material which breaches copyright law, is illegal, defamatory, libellous, offensive, fraudulent, violent, discriminatory, obscene or sexually explicit or which may adversely affect the reputation of FM Recruiter or the Site.
If the Recruiter is an employment agency or an employment business they must comply with the provisions of the Conduct of Employment Agencies and Businesses Regulations 2003 ("the Regulations") and the Employment Agencies Act 1973 in relation to all jobs posted on the Site and in communications with applicants and management of applicants' details. The Recruiter shall indemnify FM Recruiter against any Losses in connection therewith.
Job Posts should not be targeted at Job Seekers under the age of 18.
Job Posts should not be submitted for vacancies where there is a risk to the health and safety of any applicant unless the Recruiter informs Job Seekers of such risks and the steps taken to prevent or control such risks.
The Recruiter accepts sole responsibility for any detriment which it may suffer or incur in respect of the engagement of an applicant and shall hold FM Recruiter harmless against any Losses in connection therewith.
The Recruiter shall use all reasonable endeavours to ensure that it will not be detrimental to the interests of the applicant it intends to engage to work for the Recruiter in the vacancy posted.
FM Recruiter reserves the right to remove or amend any Job Post at any time at Our sole discretion. If you have any questions about why your Job Post has been removed or amended, please contact louise@FMRecruiter.com
CV Searching
Where a Recruiter account has CV search activated, the Recruiter can set filters to preview anonymous Job Seeker details on an unlimited basis. Anonymous information is provided for the purpose of enabling the Recruiter to decide if they would like to use a credit to access the Job Seekers contact details and CV, said anonymous data may include current and previous job title, skills, experience, current or desired salary, desired job type and other information provided by the Job Seeker. The Recruiter will pay 1 credit to view the personal details and CV of any Job Seeker, at their discretion the Recruiter can elect to download a CV subject to these Terms.
All Users of the Recruiter account can search, buy, download and purchase credits. Recruiters must ensure that all Users are current employees of their own company or organisation and they must immediately delete Users when they leave their organisation.
The volume of CV credits purchased will be set out in the Order Confirmation. Where Unlimited CV downloads are specified, this will be subject to a fair usage cap which will be agreed with the Recruiter.
Rules for CV searching
CV search access must only be used for recruitment purposes.
CV Search must not be used to gather data or to elicit contact for the purposes of marketing or direct selling to Job Seekers.
Recruiters must not use any automated computer program to search for and/or download Job Seeker information. ‘Scraping’ of Job Seeker data is strictly prohibited.
Recruiters will not share access to the Service with any third party who is not employed at their organisation or company. Sharing data with group organisations is prohibited.
Recruiters will not share the personal information of Job seekers with third parties unless they are acting in the capacity of an agent who is assisting a third party in finding candidates for a specific job. This will typically be where a recruitment agency has been retained to find candidates for a job.
The Recruiter is solely responsible for verifying the information provided by a Job Seeker in their profile and CV. The Recruiter is responsible for checking the Job Seekers identity, qualifications, skills, experience, eligibility to work, training, membership of professional bodies and all other information provided. FM Recruiter accepts no responsibility for validating information provided by any Job Seeker and makes no warranties as to the accuracy of this information.
Recruiters must not supply, sell or license material from the Service, or a copy of it, to any other person or organisation.
Recruiters will only be required to use 1 credit to access a Job Seeker profile and CV on the first occasion. If the same Job Seeker appears in a separate or repeated search the information will be available without any charge until such time at the Job Seeker deletes their information or changes their settings. If a Job seeker amends their information these amends will be applied to the accessible information.
Where Job Seekers set their account to request that each Recruiter requests permission to view their CV and profile information, We will ask them for this permission when Recruiters request us to do so, but we can offer no guarantee that the permission will be granted or that the Job Seeker will respond to Our request.
FM Recruiter reserves the right to suspend or terminate the CV Search service at our sole discretion when we believe the Terms have not been adhered to. If you have any questions about why this Service has been removed or amended, please contact louise@FMRecruiter.com
CV Alerts
CV alerts are designed to notify Recruiters about the availability of Job Seekers fitting the criteria Recruiters specify. CV alerts are sent by email and they can be set up, amended or cancelled at any time.
Any User of a Recruiter account can set up a CV alert.
FM Recruiter accepts no responsibility for the accuracy of information provided or the suitability of any Job Seeker in any job alert.
The Recruiter is solely responsible for verifying the information provided by a Job Seeker in their profile and CV. The Recruiter is responsible for checking the Job Seekers identity, qualifications, skills, experience, eligibility to work, training, membership of professional bodies and all other information provided. FM Recruiter accepts no responsibility for validating information provided by any Job Seeker and makes no warranties as to the accuracy of this information
Directory Entries
Directory entries can be created for the purpose of informing Job Seekers about the Recruiter’s business and the benefits of working at their organisation
The Recruiter shall not submit for inclusion in any Directory Entry any material which breaches copyright law, is illegal, defamatory, libellous, offensive, fraudulent, violent, discriminatory, obscene or sexually explicit or which may adversely affect the reputation of FM Recruiter or the Site.
The Recruiter must ensure any information provided in the Directory is true and accurate and must update information when it is appropriate to do so.
The Recruiter must not include Jobs or links to other Jobs Websites in the Directory.
The Recruiter must not provide any contact information by any means in the body copy of the Directory entry. Nor must they attempt to elicit direct contact with Job Seekers using their Directory entry.
FM Recruiter retains the right to remove Directory Entries at any time.
Pricing
The following Pricing Models are available in relation to the Services:
Job Posting pay as you go: This model applies to Job Postings, Featured Job Postings, Optimised Job Postings and Ultimate Job Postings. The Recruiter will buy the agreed number of job postings using the agreed pricing and payment method as set out in the Order Confirmation. All Job Posting credits must be used within 12 months of the date of purchase. Pricing details for this Service are available on the Website, we retain the right to alter said prices at any time.
CVs pay as you go: The Recruiter will buy the agreed number of CV download credits as set out in the Order Confirmation. The Recruiter will pay upfront for the CV download credits. All credits must be used within 12 months of the date of purchase. Pricing details for this Service are available on the Website, we retain the right to alter said prices at any time.
Monthly Recruiter Plan: The Client may post the agreed number of job postings each calendar month as set out in the Order Confirmation. The number of Job Post credits will reset on the first day of each calendar month and any credits remaining at the end of the month will be cancelled.
The client may undertake unlimited anonymous CV searches and will receive the agreed number of credits set out in the Order Confirmation to view and/or download the full profile, contact details and CV of Job Seekers who are relevant to the jobs they are recruiting for.
Monthly Recruiter Plans shall have a minimum term of 12 months unless otherwise agreed by FM Recruiter in the Order Confirmation. No refunds will be given in the case of early termination, outstanding invoices shall remain payable, and the fees in respect of any outstanding minimum term shall become payable. The Services will automatically renew for a further term of 12 months on the same terms and fees as are applicable on the date immediately prior to the relevant anniversary date, unless either party gives the other written notice to terminate at least 28 days prior to such anniversary.
Upon the termination at the end of a term all unused credits will be cancelled.
Recruiter account set up and validation
All new Recruiter accounts set up using our online registration process will be validated by FM Recruiter in order to protect Job Seekers, this validation will be via email or telephone and will typically occur within 48 hours of an application to open an account. Accounts will only be validated where it can be shown that the Recruiter attempting to create an account intends to use FM Recruiter for the purpose of finding candidates for jobs. FM Recruiter has the right in its sole and absolute discretion to refuse to offer the Services to any person, company or organisation.
All details provided by the Recruiter when applying for an account must be true and accurate. Recruiters must make suitable amendments to their account details to ensure they are up to date. We reserve the right to suspend or terminate any account where the account details are found not to be accurate.
Contract formation
A legally binding contract between FM Recruiter and the Recruiter comprising these Terms and the Order Confirmation will come into effect when (i) in the case of online orders, the screen confirming successful purchase of Services appears on the Site or (ii) in the case of orders via the FM Recruiter sales team, FM Recruiter have received written approval of a quotation detailing the Services to be provided and the cost.
The Recruiter acknowledges that such contract is conditional upon the Recruiter passing Our credit checking process.
FM Recruiter shall perform the Services using information and criteria supplied by the Client. It is the Client's responsibility to provide accurate and up to date information
Other than for Services paid for online (where We will provide payment confirmation after payment has been taken), FM Recruiter shall issue an invoice and in the case of Monthly Recruiter Plans, at agreed intervals in advance thereafter. The Recruiter shall pay Our invoices in full within 30 days of the date of invoice. In the event of late payment, We may suspend any or all of the Services until payment is received.
In the event that the Client fails to pay any invoice within 40 days of receipt of an invoice, We may terminate the Services and all outstanding invoices shall become payable immediately. In the case of Monthly Recruiter Plans, the fees in respect of any outstanding minimum term shall also become payable immediately.
FM Recruiter reserves the right to charge interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 as amended.
Online payment services will be undertaken by Stripe whose Terms and Condition can be found in our Privacy Policy.
Employment Agencies and Employment Business Regulations 2003
FM Recruiter acts in the capacity of a venue only, we are not an employment business. FM Recruiter does not make introductions between Recruiters and Job Seekers (or vice versa), and nor does it supply candidates to recruiters.
This means that we do not:
Confirm the identity of a jobseeker.
Confirm that job seekers have the required experience, skills, qualifications or training required to undertake a job.
Take up references in relation to job seekers.
Confirm then suitability of a candidate to fulfil a job in any circumstances.
Ensure job seekers are aware of legal or other requirements required to satisfy the requirements of a job.
Recruiters should undertake suitable steps to validate any Job Seeker information that they view or download and must ensure that they do not breach employment legislation.
Issues and interruptions with the FM Recruiter website
We make all reasonable efforts to ensure the standard of the FM Recruiter website is high and to maintain its continuity, however, the internet is not a completely stable medium and errors, omissions or interruptions of service may occur at any time. We do not accept any liability arising from any such errors, omissions and interruptions or any ongoing obligation or responsibility to operate this website (or any particular part of it) or to provide the Services offered on this Site. The specification of this Site may be changed from time to time without notice.
We offer no guarantees that the Site will generate applications, responses or results and no Service is guaranteed to result in a job placement.
FM Recruiter shall not be in breach of these Terms if events beyond its reasonable control prevent Us from performing the Services.
It is the Client's responsibility to protect their computers against any viruses and malware.

Entire Agreement
These Terms and, where appropriate, the Order Confirmation contain the entire agreement and understanding between Us and the Recruiter. The Recruiter acknowledges that it has not relied on any representation made by Us in entering this contract, however, nothing in this clause shall exclude any liability for fraudulent misrepresentation. To the fullest extent permitted by law, all terms implied by law or statute are excluded.
Limits to Liability
Nothing in these Terms shall be construed to exclude FM Recruiter’s liability for death or personal injury by negligence or any other liability which cannot by law be excluded.
In the event that a Recruiter makes a claim against FM Recruiter for whatever reason, FM Recruiter’s liability (if any) shall not exceed the price paid or to be paid by the Recruiter for the Services. Under no circumstances shall FM Recruiter be liable for any consequential, indirect or special losses howsoever arising or for any loss of profits, revenue, interest, goodwill, business and/or savings (whether direct or indirect).
License to use a Recruiters name trademarks and logos
The Customer grants to Us a fully paid-up, worldwide, non-exclusive, royalty-free licence during the term of the Contract to use the Customer's name, trademarks and logos (the “Customer IP”) for the purposes of providing the Services and in Our marketing materials (including, but no limited to, websites and brochures) and that We may present examples of the services provided to and the materials published on behalf of Customer.
Breach of Terms
Without prejudice to any other remedy, FM Recruiter may terminate the Recruiter’s account and any or all contracts and Services with immediate effect in the event of material or persistent breach of these Terms by the Recruiter.
Applicable Laws
These Terms and Conditions are governed by, and shall be construed in accordance with, English law.
The courts of England shall have exclusive jurisdiction to hear and decide any suit, action or proceedings, and to settle any disputes, which may arise out of or in connection with these Terms and Conditions and, for these purposes, each party irrevocably submits to the jurisdiction of the courts of England.

Use of the Site
You are permitted to use the Site for the purposes of seeking employment or to access career advice contained within the Site. You may only use, download or print information from the Site for these specific purposes. You should not keep any information that you download or print from the site for longer than necessary.
You are responsible for any information that you supply to the Site and you must ensure the information is accurate and true. You must regularly update your information to ensure that it is up to date, it is especially important that your email and contact details are updated. You must not provide misleading or inaccurate information. You must not supply any offensive, abusive, illegal, libellous, vulgar, defamatory, or discriminatory information or any information that breaches copyright, trademark or other intellectual property rights.
You agree to indemnify, defend and hold harmless FM Recruiter, our affiliates, officers, directors, employees, consultants and agents from any and all third party claims, liability, damages and/or costs (including but not limited to legal fees) arising from your use of the Site, any breach of these Terms and Conditions that you make, your infringement or infringement by any other user of your email account of any intellectual property right of any person or entity.
You must ensure that any file or information you provide is free of viruses or malware that might modify or affect the operation of the Site in any way.
We reserve the right to remove content from the Site at any time without explanation.
Users of the Site do so at their own risk. You are solely responsible for any damage to your computer system and for the loss of any data that results from your use of the Site or as a consequence of the downloading of material from the Site.
Provision of services to Job Seekers
These terms and conditions apply to your agreement with us for your use of the following services, which collectively will be known as the “Services”. Terms and Conditions apply to all of the Services except for where they are expressly stated to apply to one Service only.
1. Job Application service, which allows Recruiters (or agents acting on behalf of a Recruiter) to place job advertisements on the FM Recruiter website and for Job Seekers to view and apply for these jobs by making an application directly through the Site or by being re-directed to a third party’s website to apply through that website.
2. Job Alert service which allows you to specify your preferred job criteria and then receive emails containing details of jobs that fulfil your criteria on a frequency that you determine. You can set up multiple job alerts and you can amend or stop job alerts at any time by accessing your dashboard.
3. CV database search service, which enables recruiters to search, find, view, and download the profile information and CVs submitted by Job Seekers.
Our primary purpose is to help job seekers and recruiters to find each other, so by default participation within our CV search service is enabled for all Job Seekers. The extent to which information is shared with Recruiters is governed by the settings Job Seekers apply and can be changed at any time. For addition detail about how personal information you provide is processed and for details of how to manage your settings please read to our Privacy Policy.
If your settings enable Recruiters to find you in a CV database search, you consent to us sharing any CV that you upload, together with any additional information you provide to us, with any Recruiters who have registered to use the Website.
This means that you give us:
A non-exclusive, royalty-free, worldwide licence of any rights, including intellectual property rights, in your CV and any additional information you provide to us on the Website, to share or otherwise use such CV and additional information as we reasonably require to fulfil the services we provide on the Site.
The right to grant a perpetual, royalty-free, worldwide sub-licence of any rights, including intellectual property rights, in your CV and any additional information you provide to us on the Website, to Recruiters for their recruitment related activities.
We will retain a copy of any CV you provide to us along with any additional information you provide to us until you delete it or close your account. For further information about the retention of your data and how to delete your account refer to our Privacy Policy.
You should regularly check that your settings are relevant to your current circumstances.
You will not be charged for using the Services.
Employment Agencies and Employment Business Regulations 2003
FM Recruiter acts in the capacity of a venue only, we are not an employment business. FM Recruiter does not make introductions between Recruiters and Job Seekers (or vice versa), and nor do We supply candidates to recruiters.
This means that we do not:
Confirm the identity of a jobseeker.
Confirm that job seekers have the required experience, skills, qualifications or training required to undertake a job.
Take up references in relation to job seekers.
Confirm then suitability of a candidate to fulfil a job in any circumstances.
Ensure job seekers are aware of legal or other requirements required to satisfy the requirements of a job.
The Regulations seek to ensure that work-seekers are only proposed by Employment Agencies for roles for which they are properly qualified and that hirers are only offered Job Seekers who have the appropriate levels of experience, training, qualifications and authorisation for the position to be filled. It is recommended that, if you are a Job Seeker you undertake the steps set out in the Regulations to ensure your suitability for the role advertised, which may include:
Checking the identity of any Recruiter, the commencement date and duration of the position, the position to be filled including type of work, location, hours and risks to health and safety, experience, training, qualifications and authorisation which the hirer considers necessary or are required by law or otherwise to undertake the position, whether any expenses are payable by you as a Job Seeker or whether there are any requirements imposed by law or otherwise for you to satisfy before taking up a position.
Although we attempt to ensure Recruiters have a genuine reason for registering to use the website, we offer no warranties as to the identity of any Recruiter or the accuracy of information provided by a Recruiter.
Issues and interruptions with the FM Recruiter website
We make all reasonable efforts to ensure the standard of the FM Recruiter website is high and to maintain its continuity, however, the internet is not a completely stable medium and errors, omissions or interruptions of service may occur at any time. We do not accept any liability arising from any such errors, omissions and interruptions or any ongoing obligation or responsibility to operate this website (or any particular part of it) or to provide the service offered on this Website. The specification of this site may be changed from time to time without notice.
If you experience any problems with the Site or wish to make a complaint about the Site, any of the Services available on the Site or any Recruiters who you feel are not operating within the Terms and Conditions of use of the Site please contact louise@FMRecruiter.com
Content Rights
The rights in material on the Site are protected by international copyright, software and trademark laws. You agree to use the Site in a way which does not infringe these rights. You may only copy material on the Website for your own private or domestic purposes, copying for any commercial or business use is not permitted.
Security and Passwords
When you register with Us and login, you will need to use a username and password. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times. You should not use the same password for multiple websites and you must notify us immediately if you believe that your password is known to someone else or if it may be used in an unauthorised way. We accept no liability for any unauthorised or improper use or disclosure of any password.
Termination
We may terminate your registration and/or deny you access to the Site or any part of it including any services, goods or information available on or through the Site at any time in our absolute discretion and without any explanation or notification.
Liability
We accept no liability for any loss (whether direct or indirect, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the Site and we hereby exclude any such liability, whether in contract, tort (including for negligence) or otherwise. We hereby exclude all representations, warranties and conditions relating to the Site and your use of it to the maximum extent permitted by law.
You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of the Website.
You must notify us immediately if anyone makes or threatens to make any claim against you relating to your use of FM Recruiter.

FM Recruiter offers links to other sites which may be of interest to you. We do not accept any responsibility for or liability in respect of the content of those sites. You use these links entirely at your own risk.
Information on this Site
We make every effort to ensure that the information on our Site is accurate and complete, some of the information is supplied to us by third parties and we are not able to check the accuracy or completeness of that information. We do not accept any liability arising from any inaccuracy or omission in any of the information on our Site or any liability in respect of information on the Site supplied by you, any other user or any other person.
Closing your account with us
You can close your account at any time by accessing your dashboard and selecting the appropriate options or by contacting louise@FMRecruiter.com. Please read our Privacy Policy for further information about how we close your account and treat your data.
Social Accounts
You may use your social media accounts to create and sign into your account. Once you have created an account using your social media account, if you would like to remove access you will need to login to your social media account and make suitable adjustments.

Deceased User
In the event of the death of a user, a person authorised to act on behalf of the estate, or a verified immediate family member of the deceased can request to have the deceased user’s account removed. We will require the supply of suitable documentation for this request. All information supplied will remain confidential.
Applicable laws
These Terms and Conditions are governed by, and shall be construed in accordance with, English law.
The courts of England shall have exclusive jurisdiction to hear and decide any suit, action or proceedings, and to settle any disputes, which may arise out of or in connection with these Terms and Conditions and, for these purposes, each party irrevocably submits to the jurisdiction of the courts of England.
